中国商务签证M签证(2013年9月1日前为F签证):发给赴中国进行商业贸易活动(不包括来中国实习)的人员。

自2015年1月起,外国人入境完成短期工作或商贸行为的相关办理程序(78号文)正式推出,目前属于试行阶段,其中对于外国人来中国小于90天的短期工作或商贸行为进行了细致的区分,明确指出了哪些行为应当申请短期工作签证(Z签证);哪些行为应当申请短期商贸签证(M签证)。具体如下所列(所以外国人在国外申请签证的时候应当选择适当的签证类型):

中国工作签证(又叫Z签证或叫居留许可证)是颁发给在中国受雇的外国人的签证。

你可以在所在国中国大使馆或香港领事馆获取中国工作签证。你只需要提供两份基本文件:一个是外国人就业许可和z签证邀请函或称为Z签证通知书。大多数中国领事馆要求出示这两个文件原件。除了这两个文件外还要所在国或其他国家健康证明。

Z2 Service: Change your Working Permit and Residence Permit from employer A to employer B:

1. Passport with valid residence permit
2. Old working permit (from employer A)

Notice 1: If Company A and Company B is not in the same industry (for example, Company A is consulting company and company B is restaurant), then the application failure rate is much higher.
Notice 2: According to the immigration regulation, after we submit your new Alien Employment permit (with employer B), you need to give up your former residence permit of employer A and change it to a 1 month 0 entry M visa immediately to avoid the illegal employment, it will cost extra money and time.

China R visa or we can called China Talents Visa is issued to those who are high-level qualified talents or whose skills are urgently needed by China.

Start from 1st July 2015, Shanghai entry and exit bureau release some new rules, especially for how to determine the high-level qualified talents, and how they can apply the China talents visa (R visa) or China green card (D visa):

How to apply the R type visa – China residence permit (Talents):

It’s exactly the same procedure and quotation as applying the working Z visa (you can check the right side menu “Working Z Visa” section to have all our service details). The only difference is if you count as a high-level qualified talents (which means you can provide the extra document from above government ministry), then you will get 5-years working residence permit (with Talents mark on it), the normal employee only can get the 1-year working residence permit (with Working mark on it). After you have 3 years continuous Talents working residence permit, then you can apply the China green card from the 4th year.

China Dependent visa (Q visa and S visa) introduction:

Base on the new immigration law started from 1st Sept. 2013, China have now 4 categories family visa as following:

Q1 visa Issued to those who are family members of Chinese citizens or of foreigners with Chinese permanent residence (China green card holder) and intend to go to China for family reunion, or to those who intend to go to China for the purpose of foster care. The intended duration of stay in China exceeds 180 days. (Need to do a medical checkup)
“Family members” refers to spouses, parents, sons, daughters, spouses of sons or daughters, brothers, sisters, grandparents, grandsons, granddaughters and parents-in-law.
Q2 visa Issued to those who intend to visit their relatives who are Chinese citizens residing in China or foreigners with permanent residence (China green card holder) in China. The intended duration of stay in China is no more than 180 days. (NO need to do a medical checkup)
S1 visa Issued to those who intend to go to China to visit the foreigners working or studying in China to whom they are spouses, parents, sons or daughters under the age of 18 or parents-in-law, or to those who intend to go to China for other private affairs. The intended duration of stay in China exceeds 180 days. (need to do a medical checkup)
S2 visa Issued to those who intend to visit their family members who are foreigners working or studying in China, or to those who intend to go to China for other private matters. The intended duration of stay in China is no more than 180 days. (NO need to do a medical checkup)
“family members” refers to spouses, parents, sons, daughters, spouses of sons or daughters, brothers, sisters, grandparents, grandsons, granddaughters and parents-in-law.

Friendly Notice:
According to the local shanghai immigration policy, For the first time when you apply the Residence permit , you have to show up (the second time no need to show up) in the government to take a digital picture, they need to confirm you are the same person of the passport holder then the officer will accept your visa application.

If applicant hold a any kind of other visas now, then “Relationship certificate” need to be authenticated by Chinese Embassy/Consulate in his/her country. If applicant is already in China, then go to his/her Consulate in shanghai to get authenticated also works.

Notice 2: Direct relative means spouses, parents, sons or daughters under the age of 18 or parents-in-law.

 

S2 Service: Visit foreign family member who is working in shanghai, I want to apply 1-3 month S2 visa:

Important Notice: This service is only available for those partners who are not official married, but have physical baby together!

*** If both of parents are foreigner, either of them has working residence permit, then the baby can apply the same length of the family residence permit directly in shanghai.
*** If both of parents are foreigner, none of them has working residence permit, then the baby can apply only 1 month visa for exiting and re-apply a new visa outside of China.
*** If one of baby’s parents is Chinese nationality, then the baby can apply only 1 month visa for exiting and after the baby come back with a new visa, use the Q1 service to get longer term residence permit.

To apply for China M business visas, you are required to provide a letter of invitation (LoI) issued by a Chinese company, there are 2 kinds of LoI:

  • Normal LoI: The invitation letter written and stamped by the company itself.
  • Official LoI: The invitation letter issued by the Shanghai foreign affair department. (Company need to apply it through the government department)

With either of above invitation letter, you can get the M visa in the Chinese Embassies/Consulates. The difference between those 2 kind of LoI is: If you get your M visa with the normal LoI, then it’s not possible to extend your M visa here in Shanghai. If you get your M visa with the official LoI, you can extend your M visa in Shanghai.

Important Notice: Only the company who invite you with official LoI can support you to get your M visa extension in Shanghai. So if you plan to do the M visa extension in shanghai, then we suggest the company apply the official LoI instead of the letter written by the company itself.

China Green Card (China permanent residence) or we called China PR is issued to those who are going to reside in China permanently. Before if you want to apply the China green card, the access threshold is very high. So in shanghai, there are 170,000+ foreign expats living and working in shanghai, but only 2400 person successfully got the China permanent residence. Right now, there is a good news from 1st July 2015, Shanghai public security bureau relax the China green card’s policy. Right now more and more foreigners have the benefit to apply it.

Who will get benefit from the new China Green Card’s policy?

  • High Earners: For those foreign expats who worked in shanghai continuously for 4 years, every year stay in China over 6 month. Salary is over 600,000RMB per year and paid his/her Shanghai incoming tax over 120,000RMB per year, with no criminal record.
  • Foreign Talents: For those foreign expert who have the China Talents visa (R visa, more details about how to apply R visa, please check the right side menu “Talents R visa” section), and continuously work in shanghai for 3 years, with no criminal record.

What’s the benefit for foreigner who has China PR?

  • It’s for 10 years continuous stay, and multiple entries.
  • If you got the China green card, your foreign spouse and child can apply it as well.
  • You can bring a foreign personal housekeeper(maid) to Shanghai, and you can sponsor him/her to get a S1 visa (mark as personal affair )

How to apply the China Permanent Residence card?

1. Original Passport (you should have 4 years continuous shanghai working residence permit, if it’s in old passport, you need to provide the old passport as well)
2. Original Work Permit (or we call Alien Employment Permit, a brown booklet)
3. Your company salary receipt or contract for the last 4 years to prove that your salary reach the 600,000 every year.
4. Official Tax receipt from tax bureau to prove that for the last 4 years you have paid 120,000RMB for your personal incoming tax every year.
5. 2 Passport Photographs (2 inches size: 3.5cm*4.5cm) in original and digital.
6. Original Registration Form Of Temporary Residence (Updated with your current address and passport number).
7. Company Business License (original and copy) .
8. Company Enterprise Code License (original and copy).
9. Company Approval Certificate (only for foreign investment company)(original and copy).

11. Your home country police clearances to prove you don’t have criminal record in your country (legalized by Chinese Embassy/Consulate in your home country)

  • If foreign expat work in shanghai continuously for 4 years, every year stay in China over 6 month. Your salary is over 600,000RMB per year and you paid your incoming tax for 120,000RMB per year, with no criminal record in your home country, then you can apply permanent residence permit (China green card or we called D visa);
  • If you work for the company which has the valid high-tech certificate , you can apply for the talents residence permit (R visa) for 5 years, after you continuously work for the company over 3 years, then you can apply the permanent residence permit (China green card);
  • Above 2 kind of foreign expat, can personally hire a foreign maid (ayi) and support the maid (ayi) to get a same length personal affairs residence permit (S1 visa);
  • For the university (in China) fresh graduated foreign student, if you plan to invest in Shanghai or open your own business in shanghai, you can apply 2 years personal affairs residence permit (S1 visa) until your business established.
  • For a normal foreign employee, you can apply the Z visa without leaving the country, this is very good since it can save a lot of money and time. (VisaInChina need to double confirm when it will take effect);
  • For a normal foreign employee, after 2 years continuous working in shanghai with a working visa, if you don’t break any China immigration laws and regulations, you can apply 5 years long term working residence permit.

25th June 2015, From 1st July 2015, Taiwanese can enter mainland China with visa free, they just need to carry the valid TaiBaoZheng (in English: Mainland Travel Permit for Taiwan residents – MTP). More details of visa free policy for Taiwan residents:

5th March 2015, China has a new rule (no.78 Rule) start from Jan 2015, especially for foreigner who comes into China to finish a short term work (less than 90 days). In that rule, it determines which kind of situation count as a short term working and what situation count as a short term business. Right now we can only see an outline of that rule, more details about how to process the short term working visa, it’s still under discussion (VisaInChina will focus it and keep update).   • Foreigner comes to Chinese Co-operation Company to finish some technical, scientific research, management or guidance job
  • Foreigner comes to Chinese sport club/organization to have a trial (including coach and athlete)
  • Foreigner comes to China for a film shooting (including advertisement film and documentary film)
  • Foreigner comes to China for a fashion show (including model)
  • Foreign performance (for commercial performance)

Which situation does NOT count as a short term working? (less than 90days)

  • Mechanical after sales team come to China to repair, install, maintain, remove, guidance, training (Apply M visa)
  • Bid Winner come to China to do the project guidance, supervision, checking (Apply M visa)
  • Foreigner from head office goes to shanghai branch, representative office to have some short term work (Apply M visa)
  • Foreigner comes to China to attend the sports event, including coach, athlete, team doctor, assistant etc. (Apply M visa)
  • Foreigner comes to China work as a volunteer (Apply F visa)
  • Foreign performance (for non-commercial performance) (Apply F visa)

Q1: If I enter China on 2nd Sept 2014, how long can I stay?
A: Since you Enter Before 3rd Sept 2014, you still can stay 30 days until 2nd Oct 2014.

Q2: Following above situation, I enter China on 2nd Sept 2014, on 30th Sept 2014, I want to go to Thailand for a visit and come back on 10th Oct 2014, can I do that with my current visa?
A: You can leave China, but you can not enter China with this visa, because this visa requests you enter China before 3rd Sept 2014, so it means you must apply a new visa in Thailand to come back on 10th Oct 2014.
